CHARLES AVRITH

Charles Avrith has extensive experience in all aspects of business litigation, including jury and court trials, discovery, motions and appeals. Mr. Avrith has tried numerous cases on behalf of plaintiffs and defendants in federal and state courts, as well as before arbitrators and administrative panels.

Prior to joining Ross LLP as a founding partner, Mr. Avrith had been a partner at Browne George Ross O’Brien Annaguey & Ellis, and was previously a partner at Nagler & Associates since 2006, a small Westside firm specializing in business litigation. Prior to that, he was a litigation partner at the Los Angeles office of Hughes Hubbard & Reed, where he worked for 20 years.

Representative Matters

  • Obtained a $47.5 million judgment after trial on a claim for alter ego liability against a Hong Kong listed corporation for diverting assets of a Canadian corporation. Collected much of the judgment through proceedings in U.S. and Hong Kong against the Hong Kong corporation’s shareholders

  • Obtained award of $5.5 million, plus $2.5 million in attorneys’ fees, against founder of Hard Rock Café Enterprises in a breach of contract action

  • Obtained judgment on behalf of a public company, and its officers and directors, in class action securities litigation

 

  • Obtained summary judgment on behalf of major pharmaceutical manufacturer in national consumer fraud and products liability class action

  • Successfully defended major accounting firm against ERISA class action

  • Successfully defended retail chain against wage and hour class action

  • Defended bank president in FDIC enforcement action

  • Obtained injunction after court trial requiring school district to remediate PCB contamination

  • Represented major investment firm against claim by former partner for breach of contract and fiduciary duty

  • Successfully defended American subsidiary of French aerospace manufacturer against multi-plaintiff discrimination claims

  • Successfully defended major Japanese trading company against claim for breach of contract and fraud

  • Obtained judgment on behalf of major retailer after jury trial against national insurance broker

  • Obtained favorable settlement after jury trial for major insurer in malpractice claim against former law firm

  • Successfully defended NYSE listed corporation against whistleblower claim
